Acceptable Use Statement and Policy

  1. Introduction
    NFDC Internet Connection, hereafter called "NFDC," has established these Operating Rules to help make your online usage and communications a positive and secure experience. By your continued use of NFDC, you agree to be bound by these rules and this service agreement, which is incorporated by reference in these rules. The terms of the Service Agreement also apply to these Operating Rules and vice versa. NFDC may modify without prior notice to you these Operating Rules or the incorporated Service Agreement at any time by publishing the modified rule(s) over the Service.
  2. Copyrighted Material
    You must not use NFDC to upload, transmit or post copyrighted or otherwise protected material to the Internet without the permission of the owner(s) or person(s) owning the copyright or other intellectual property rights in the transmitted materials. Only the owner(s) or persons specifically authorized by the owner(s) may use NFDC to upload, post or transmit copyrighted or otherwise protected material. If you download from the Internet copyrighted or otherwise protected material you must do so with the express permission of the owner(s) or other authorized persons regarding copying, redistribution, modification or publication.
  3. Content & Uses of NFDC
    You agree not to publish on or over NFDC any information, software , unsolicited, bulk, or "junk" E-mail, or other content which violates or infringes upon the rights of any other person or which would be abusive, profane or offensive to an average person. You agree not to use the facilities and capabilities of NFDC to conduct any business or activity or to solicit the performance of any activity which is prohibited by law. You agree to comply with all applicable laws, rules and regulations in connection with your use of NFDC. You acknowledge that you are aware that areas accessible through NFDC may contain material unsuitable for minors (persons under 18 years of age). You agree to supervise usage of NFDC by minors whom you permit to use NFDC. You acknowledge that, when using the Internet, you are accessing content that is not controlled by NFDC. The reliability,availability and content of such resources accessed through the Internet are beyond NFDC's control and are not in any way warranted or supported by NFDC. You acknowledge that safeguards relative to copyright, ownership, decency, reliability and integrity of content are entirely lacking with respect to the Internet and content accessible through it. You assume all risk and liability of your use of the Internet, including your continuous compliance with these Operating Rules.
  4. Service Termination
    NFDC reserves the right at its sole discretion and without prior notice to suspend and/or terminate your access to NFDC at any time and for any reason. In the event that your access to NFDC is terminated (including for nonpayment), NFDC, at its sole discretion, may refuse to accept all new e-mail sent to your terminated e-mail address.
  5. Unauthorized Access and Hacking
    Unauthorized access to NFDC or its servers is strictly prohibited. You agree that you will not engage in such activity or attempt to break into NFDC servers or facilities for the purpose of altering or manipulating the hardware and software comprising NFDC, or for any other unauthorized use of any kind ("hacking"). You agree that you will be responsible for and indemnify NFDC for any liability of any kind arising from the use of your password for such purposes.
  6. Indemnification
    You agree to indemnify and hold NFDC harmless from any claims and expenses, including reasonable attorneys' fees, related to your violation of these Operating Rules, the Service Agreement, applicable laws or unauthorized use of any software or other content obtained by you from the Internet using NFDC.
  7. Use of Account
    Your right to use your personal service is personal to you alone and is not transferable or usable by more than one person at one time. You may not lease or otherwise assign or sublet your personal service account to others. Your personal service is subject to any limits established by NFDC or by your credit card company if billing is through a credit card. You may not under any circumstances resell to any other person or entity the service you receive through your personal account, nor may you use your personal PPP account as a server or dedicated link to access to files or internet services from your remote computer. Multiple members of the same household may share a single access account. However, only one person is authorized to access NFDC at any given time through use of that account.
  8. Hard Drive Space, E-Mail Use and Privacy
    You are guaranteed a minimum of five (5) megabytes of hard drive space for file storage. At its discretion, however, NFDC may allocate more space to your use. Due to limitations on hard drive space on the mail server, however, you are restricted to three (3) megabytes of undelivered e-mail and attached files. Should the e-mail server overload and reset due to violations of this rule, you may lose undelivered e-mail. NFDC takes no responsibility for lost e-mail due to violations of this rule by its members.

    NFDC believes that all mail messages must remain absolutely private so that you will have the confidence to regularly use the Service. Any hint of monitoring could undermine your trust and slow our business growth, so we maintain strict policies which can be summarized by the following statements:

    1. NFDC will employ at its own discretion various automated measures that may scan and reject e-mail. Said automated measures are used by NFDC in the best interest of its subscribers. NFDC provides automated measures to reduce the introduction of e-mail viruses and unsolicited commercial e-mail (UCE or SPAM.) While NFDC offers this service in good faith, some e-mail may be delayed or rejected because of false positive readings. Furthermore, some UCE or virus laden e-mail may escape detection. By using NFDC's e-mail servers, you agree that you will indemnify NFDC for any liability of any kind arising from its use of automated e-mail scanning.

    2. NFDC employees are prohibited from disclosing mail communications if an employee sees a member's message while performing his or her job (such as technicians aiding in customer problem resolution).
  9. Use of Personal Web Pages
    Personal web pages provided to you as part of your personal service may be used only for non-commercial activities. Should you need commercial website capabilities and capacity, NFDC will be happy to assist you in setting up commercial web pages for that purpose.

    NFDC wants to provide it's users with the best internet service possible, by reading and complying with our Acceptable Use Policies, you are helping us to achieve this goal.
